Here there was an overt act to use force (her SUV) to delay and prevent enforcement of federal law by ICE-agents, as well as an agreement that the other one would film and agitate... meanwhile assaulting and endangering federal agents didn't help things.

She was driving away... She had no intention of hitting anyone... You can give him the first bullet, but the next two shots were murder; the danger had passed... if she hit the officer, it was done in accident...
